1. Definitions

"Client" means a school, sports club, or organisation that subscribes to the mymeddiCAL platform.

"User" means a staff member, administrator, guardian, or other authorised individual who accesses the platform on behalf of a Client.

"Student / Athlete" means a child or young person whose health and wellbeing information is managed through the platform by a Client.

"Client Data" means all personal information uploaded or entered into the platform by a Client or User, including health plans, incident records, and medication schedules.

"Services" means the mymeddiCAL web platform, mobile application (iOS and Android), and all related services.

2. Our Role

mymeddiCAL operates as both a data controller and a data processor depending on context:

  • Data controller — for information we collect directly, such as account holder details, billing information, and website usage data

  • Data processor — for Client Data entered by schools and sports clubs, including student and athlete health records. In this role, we act on the instructions of the Client, who remains the data controller for that information

Schools and sports clubs are responsible for ensuring they have appropriate consent and legal authority to upload personal information about students, athletes, and guardians into the platform.

3. Information We Collect

A. Information you provide directly

  • Name, email address, phone number

  • Organisation name and address

  • Account login credentials

  • Billing and payment information (processed via Stripe — we do not store card details)

  • Communications with our support team

B. Client Data (processed on behalf of schools and clubs)

When authorised by a Client, mymeddiCAL may process:

  • Student and athlete identity information (name, date of birth, year level, team)

  • Health plans, medical conditions, and medication schedules

  • Incident and medication event records

  • Guardian contact details and portal access information

  • Staff roles, certifications, and account details

We process this data only as directed by the Client and do not use it for any other purpose.

C. Special categories of sensitive information

mymeddiCAL processes health information about students and athletes, which is a sensitive category under the Australian Privacy Principles. We apply additional safeguards to this data including encryption at rest and in transit, strict role-based access controls, and tenant-level data isolation.

D. Website and usage data

We automatically collect:

  • IP address and device information

  • Browser type and operating system

  • Pages visited and usage patterns

  • Referring URLs

 

4. Children's Data

The nature of our Services means we collect, store, and process personal information relating to children and young people (students and athletes) on behalf of schools and sports clubs.

We take the following steps to safeguard children's data:

  • All student and athlete data is isolated at the tenant level — a user in one organisation cannot access data from another

  • Guardians can only view data relating to their own linked children

  • Staff access is restricted by role — team managers and coaches see only their assigned teams

  • Health data is never used for marketing, advertising, or any purpose beyond providing the Services

  • We do not knowingly collect personal information from children directly — all data is entered by authorised adults (staff or guardians)

5. How We Use Information

We use personal information to:

  • Provide, operate, and maintain the Services

  • Authenticate users and manage access

  • Support health and medication management workflows

  • Send service notifications (medication reminders, incident alerts, guardian notifications)

  • Process subscription payments

  • Respond to support requests

  • Improve platform performance and security

  • Comply with legal and regulatory obligations

We do not use personal information for advertising, profiling, or sale to third parties.

 

6. Cookies and Tracking Technologies

mymeddiCAL uses cookies and similar technologies to:

  • Analyse website performance (using de-identified, aggregated data)

We do not use third-party advertising cookies. You may manage cookie preferences through your browser settings. Disabling cookies may affect platform functionality.

 

7. How We Share Information

  • With service providers who support our infrastructure, security, and operations (including AWS for cloud hosting, Stripe for payments, and email delivery providers) — under strict contractual obligations and only for specified purposes

  • With the Client whose account you belong to, where relevant to your role

  • For legal compliance, including in response to a court order, subpoena, or lawful regulatory request

  • In a business transaction such as a merger or acquisition, with prior notice where required

We do not sell personal information. We do not permit service providers to use personal information for their own purposes.

 

8. Data Security

We implement the following safeguards to protect personal information:

  • Encryption in transit (TLS) and at rest

  • Role-based access controls

  • Tenant-level data isolation (each organisation's data is logically separated)

  • Audit logging of key actions

  • Server-side session management with JWT revocation

  • Secure AWS cloud infrastructure (ap-southeast-2, Australia)

  • Regular security reviews

No system is completely secure. In the event of a data breach, we will act in accordance with our obligations under the Notifiable Data Breaches (NDB) scheme.

 

9. Notifiable Data Breaches

mymeddiCAL is subject to the Notifiable Data Breaches (NDB) scheme under the Privacy Act 1988 (Cth). If we become aware of an eligible data breach that is likely to result in serious harm to affected individuals, we will:

  • Notify the affected individuals as soon as practicable

  • Notify the Office of the Australian Information Commissioner (OAIC)

  • Take immediate steps to contain the breach and prevent further harm

 

10. Data Retention

We retain personal information only as long as necessary for the purposes for which it was collected, or as required by law:

  • Active account data — retained for the duration of the subscription

  • Health and incident records — retained for 7 years after account closure (in line with standard Australian record-keeping obligations), unless a Client requests earlier deletion and legal obligations permit

  • Billing and financial records — retained for 7 years after the relevant transaction (Australian tax law)

  • Audit logs — retained for 2 years

  • Deleted accounts — personal data is purged within 30 days of confirmed account deletion

Data may be anonymised rather than deleted where we have a legitimate interest in retaining aggregated statistics for service improvement.

 

11. Your Privacy Rights

Under the Privacy Act 1988 (Cth) and the Australian Privacy Principles, you have the right to:

  • Access the personal information we hold about you

  • Correct inaccurate or incomplete information

  • Request deletion of your personal information (subject to legal obligations)

  • Opt out of any direct marketing communications

  • Make a complaint about how we handle your personal information

For data relating to students or athletes managed by a school or sports club, please contact the relevant organisation directly — they are the data controller for that information.

mymeddiCAL is an Australian company. Our primary infrastructure is hosted in AWS Sydney (ap-southeast-2). Some support functions and third-party services may involve processing outside Australia. Where this occurs, we ensure appropriate protections are in place consistent with the Australian Privacy Principles.

 

13. Third-Party Links

Our platform may contain links to third-party websites or integrations. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing any personal information.

 

14. Changes to This Policy

1. Acceptance of Terms

By accessing, using, or registering for the mymeddiCAL service ("Service", "Platform", "we", "us", "our"), you ("User", "you", "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and mymeddiCAL. If you are using the Service on behalf of an organisation (such as a school, camp, or healthcare facility), you represent and warrant that you have the authority to bind that organization to these Terms.

 

2. Service Description

2.1 Nature of Service

mymeddiCAL is a REMINDER SERVICE ONLY. The Service provides:

  • Reminder notifications for scheduled medication administration and health care events

  • Data storage and organisation of medical information entered by authorised users

  • Communication tools for coordinating care between authorised parties

  • Administrative tools for managing health plans and schedules

 

2.2 What mymeddiCAL Does NOT Provide

mymeddiCAL DOES NOT:

  • Provide medical advice, diagnosis, or treatment recommendations

  • Prescribe medications or suggest dosages

  • Make medical decisions or recommendations

  • Replace professional medical judgment

  • Guarantee the accuracy, completeness, or timeliness of any information

  • Provide emergency medical services

  • Act as a healthcare provider or medical professional

 

2.3 Source of Information

All medical information, medication details, schedules, and health plans displayed in the Service are solely based on information entered by:

  • School administrators

  • Medical staff (nurses, healthcare providers)

  • Parents or guardians

  • Other authorized users of your organization

  • mymeddiCAL does not create, verify, or validate any medical information We are a passive conduit for information entered by authorized users.

 

3. No Medical Advice Disclaimer

3.1 Not a Medical Service

THE SERVICE IS NOT INTENDED TO BE, AND DOES NOT CONSTITUTE, MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. The Service is a technological tool for organizing and reminding users of information that has been entered into the system.

 

3.2 No Medical Recommendations

mymeddiCAL, its employees, contractors, and affiliates DO NOT:

  • Recommend medications, dosages, or treatment plans

  • Provide medical opinions or diagnoses

  • Endorse any particular medical approach or treatment

  • Make decisions about patient care

  • Interpret medical information or prescriptions

 

3.3 Professional Medical Judgment Required

ALL MEDICAL DECISIONS MUST BE MADE BY QUALIFIED HEALTHCARE PROFESSIONALS. Users are solely responsible for:

  • Verifying all medication information with prescribing physicians

  • Confirming dosages and administration methods

  • Validating health plans and care instructions

  • Making all medical and care decisions

  • Consulting with healthcare providers for any medical questions

 

4. Reminder Service Limitations and Disclaimers

4.1 No Guarantee of Delivery

MYMEDDICAL DOES NOT GUARANTEE THAT REMINDERS WILL BE DELIVERED, RECEIVED, OR VIEWED. Reminders are provided as a convenience service only and may fail to be delivered or received due to circumstances beyond our control, including but not limited to:

  • Technical failures of the Service, servers, or infrastructure

  • Network connectivity issues (internet outages, cellular network failures)

  • User device issues (device turned off, battery drained, app not installed)

  • Browser or application failures (browser popups blocked, notifications disabled, app crashes)

  • Email delivery failures (spam filters, email server issues, incorrect email addresses)

  • SMS delivery failures (carrier issues, incorrect phone numbers, message blocking)

  • User configuration errors (notifications disabled, incorrect settings, account issues)

  • Thirdparty service failures (email providers, SMS gateways, cloud infrastructure)*Scheduled maintenance or system updates

  • Force majeure events (natural disasters, cyber attacks, government actions)

 

4.2 No Liability for Missed Reminders

 

 

MYMEDDICAL SHALL NOT BE LIABLE FOR ANY HARM, INJURY, DAMAGE, OR LOSS RESULTING FROM:

  • Missed, delayed, or undelivered reminders

  • Failure of reminder notifications (browser popups, emails, SMS)

  • Technical malfunctions or system failures

  • Network or connectivity issues

  • User error or misconfiguration

  • Third party service failures

  • Any other failure of the reminder system

  • Users acknowledge and agree that they:

  •  Cannot rely solely on the Service** for medication administration or health care

  • Must maintain their own records and schedules independent of the Service

  • Are responsible for all medical decisions regardless of reminder delivery

  • Must verify all information independently with healthcare providers

  • Assume all risks associated with using a reminder service

 

4.3 User Responsibility for Care

USERS ARE SOLELY RESPONSIBLE FOR:

  • Ensuring medications are administered correctly and on time

  • Maintaining backup systems and records independent of the Service

  • Verifying all medical information and schedules

  • Following healthcare provider instructions regardless of reminder delivery

  • Making all medical and care decisions

  • Seeking appropriate medical attention when needed

  • The Service is a supplementary tool only and should never be the sole method for managing medication administration or health care.

 

 5. Information Accuracy and User Responsibility

5.1 UserEntered Information

All medical information, medication details, schedules, and health plans in the Service are entered by authorized users. MyMeddiCAL does not:

  • Verify the accuracy of userentered information

  • Validate medical information against medical databases

  • Confirm dosages, schedules, or administration methods

  • Check for drug interactions or contraindications

  • Ensure information is current or uptodate

 

5.2 User Responsibility

Users are solely responsible for:

  • Entering accurate and complete information

  • Verifying all information with healthcare providers

  • Keeping information current and uptodate

  • Ensuring information is correct before relying on it

  • Correcting any errors or inaccuracies

  • Validating medication details against prescriptions

 

5.3 No Warranty of Accuracy

MYMEDDICAL PROVIDES NO WARRANTY, EXPRESS OR IMPLIED, REGARDING:

  • The accuracy, completeness, or timeliness of any information

  • The correctness of medication dosages or schedules

  • The appropriateness of any health plan or care instruction

  • The suitability of the Service for any particular purpose

 

6. Technical Service Availability

6.1 Service Availability

MyMeddiCAL does not guarantee that the Service will be:

  • Available at all times

  • Free from errors, bugs, or interruptions

  • Compatible with all devices or browsers

  • Accessible from all locations

  • Secure from unauthorized access or attacks

 

6.2 Service Modifications

MyMeddiCAL reserves the right to:

  • Modify, suspend, or discontinue the Service at any time

  • Perform maintenance that may interrupt service

  • Update features, functionality, or interfaces

  • Change technical requirements or compatibility

  • Limit access or usage as necessary

 

6.3 No Liability for Service Interruptions

MYMEDDICAL SHALL NOT BE LIABLE FOR ANY DAMAGES RESULTING FROM:

  • Service unavailability or interruptions

  • Technical failures or malfunctions

  • Maintenance or updates

  • Changes to the Service

  • Incompatibility with user devices or systems

 

7. Limitation of Liability

7.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYMEDDICAL'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO MYMEDDICAL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

 

7.2 Exclusions

MYMEDDICAL SHALL NOT BE LIABLE FOR ANY:

Indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or data

  • Medical expenses or healthcare costs

  • Personal injury or death

  • Property damage

  • Emotional distress

  • Loss of business opportunities

  • Damages resulting from:

  • Missed or delayed reminders

  • Failure of notification systems

  • Inaccurate or incomplete information

  • Service unavailability or interruptions

  • Technical failures or malfunctions

  • User error or misuse

  • Third party actions or failures

 

7.3 Medical and HealthRelated Claims*IN NO EVENT SHALL MYMEDDICAL BE LIABLE FOR ANY MEDICAL, HEALTH RELATED, OR CARE RELATED HARM, INCLUDING BUT NOT LIMITED TO:

  • Incorrect medication administration

  • Missed medication doses

  • Adverse drug reactions or interactions

  • Medical complications or injuries

  • Health deterioration or death

  • Any consequences of missed or delayed care

  • These exclusions apply regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if MyMeddiCAL has been advised of the possibility of such damages.

 

8. Indemnification

You agree to indemnify, defend, and hold harmless mymeddiCAL, its affiliates, officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use or misuse of the Service

  • Your violation of these Terms

  • Your violation of any law or regulation

  • Your infringement of any third party rights

  • Information you enter into the Service

  • Medical decisions or care provided based on Service information

  • Any harm resulting from missed, delayed, or undelivered reminders

  • Your reliance on the Service for medical or care decisions

 

9. User Conduct and Responsibilities

9.1 Authorised Use Only

You agree to use the Service only:

  • For lawful purposes

  • In accordance with these Terms

  • In compliance with all applicable laws and regulations

  • With proper authorisation from your organisation

  • In a manner that does not infringe on others' rights

 

9.2 Prohibited Activities

You agree NOT to:

  • Enter false, inaccurate, or misleading information

  • Use the Service for any illegal purpose

  • Attempt to gain unauthorised access to the Service

  • Interfere with or disrupt the Service

  • Reverse engineer or attempt to extract source code

  • Use automated systems to access the Service without permission

  • Share your account credentials with unauthorised persons

  • Violate any applicable healthcare privacy laws (HIPAA, etc.)

 

9.3 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials

  • All activities that occur under your account

10. Privacy and Data Protection

  • mymeddiCAL acts as a Business Associate where applicable

 

11. Intellectual Property

The Service, including all content, features, functionality, design, and technology, is owned by mymeddiCAL or its licensors and is protected by copyright, trademark, and other intellectual property laws.

 

11.2 User Content

You retain ownership of information you enter into the Service. By entering information, you grant mymeddiCAL a license to:

  • Store, process, and display the information as necessary to provide the Service

  • Use aggregated, anonymized data for service improvement

12. Termination

12.1 Termination by You

You may stop using the Service at any time by:

  • Canceling your account (if applicable)

  • Requesting account deletion

Upon termination:

  • Your right to use the Service immediately ceases

  • mymeddiCAL may delete or retain your data as permitted by law

  • Provisions that by their nature should survive will survive

 

13. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.

13.2 Dispute Resolution Process

Any disputes arising from or related to these Terms or the Service shall be resolved through:

1. Good Faith Negotiation: Parties agree to attempt to resolve disputes through good faith negotiation for at least 30 days

14. General Provisions

14.1 Entire Agreement

These Terms, together with the Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and mymeddiCAL regarding the Service.

14.2 Modifications

mymeddiCAL reserves the right to modify these Terms at any time. Material changes will be communicated through:

  • Email notification to registered users

  • Prominent notice on the Service

  • Updated "Last Updated" date

  • Your continued use of the Service after such modifications constitutes acceptance of the modified Terms.

14.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

 

14.4 Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

 

14.5 Assignment

You may not assign or transfer these Terms or your rights hereunder without MyMeddiCAL's prior written consent. mymeddiCAL may assign these Terms without restriction.

 

14.6 Force Majeure

mymeddiCAL shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, cyber attacks, government actions, or failures of thirdparty services.

  • You have consulted with legal counsel if needed before agreeing to these Terms
